These terms and conditions (the "Terms and Conditions") govern the use of www.superhumanhealth.co.uk (the "Site"), all subdomains which fall underneath This Site and the products and services sold by this Site. This Site is owned and operated by Imperion Health LTD, a registered company in the United Kingdom.
This Site is a health education resource.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property

All content published and made available on our Site is the property of Alexander Joel Brookes and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.Acceptable UseAs a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;

  • Violate the rights of other users of our Site;

  • Violate the intellectual property rights of the Site owners or any third party to the Site;

  • Hack into the account of another user of the Site;

  • Act in any way that could be considered fraudulent; or

  • Post any material that may be deemed inappropriate or offensive.

    If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

    Accounts

    When you create an account on our Site, you agree to the following:

  • You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  • All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services

These Terms and Conditions govern the sale of goods and services available on our Site. The following goods are available on our Site:

  • Superhuman Health Protocol;

  • Educational Health Courses; and

  • Educational Health Programmes.

    The following services are available on our Site:

  • Educational Functional Health Coaching.

The services will be paid for in full when the services are ordered.These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Subscriptions

Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.To cancel your subscription, please follow these steps: Users must notify Superhuman Health in writing to info@superhumanhealth.co.uk no later than 30 calendar days before the collection of their subscription payment. Notice later than this will result in payment collection as usual and cancellation from the next month.Cancellation of subscriptions removes user access to any and all course materials and/or supports which were included in their package on the last day of their term.

Free Trial

We offer the following free trial of our goods and services:

  • In some instances under promotional offers we may offer free trials, package deals or complementary access to other programmes;

  • This will only be valid for specified products and services included in bundle deals and should not be misconstrued as a normal offer;

  • Any promotional offers are only valid for the time period they are active and to the products to which they are attached;

  • These promotional offers cannot be used in conjunction with any other promotional discount or offer.

    At the end of your free trial, the following will occur:

  • You will automatically be charged the programme cost;

  • Which may vary depending on the product or service you subscribed to;

  • Please ensure to check your product cost before subscribing.

  • In the instance of a free trial, if you do not want to be billed, you will need to cancel your subscription before your free trial ends.

    To cancel your free trial, please follow these steps: Log in to your account and select "Cancel Free Trial" under the "Account Management" tab.

    Payments

    We accept the following payment methods on our Site:

  • Credit Card;

  • PayPal;

  • Debit; and

  • Apple Pay.

    When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use.

    By providing us with your payment information, you authorise us to charge the amount due to this payment instrument via our secure third party payment processor, Stripe.If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

    Refunds

    Refunds for Physical Goods:

  • Refund requests must be made within 14 days after purchase of your physical goods.

    Refunds do not apply to the following goods:

  • Promotional Packages;

  • Bundle Offers; and

  • Digital Products.

    Refunds for Services:

    We provide refunds for services sold on our Site as follows:

  • The 14 day "Love it or leave it" guarantee applies to the flagship Superhuman Health Protocol programme only.

  • Which initiates from date of purchase.

  • With refund totalling payment made minus the cost of non-transferrable physical goods required for the service the client agreed to purchase.

  • Which at time of creation March 2024, totals £600.00 GBP in physical goods required for Superhuman Health Protocol service.

  • Refunds will not be given outside of this time for any reason.

  • Nor can the programme be paused or suspended or transferred.

    Guarantees

    The following guarantees apply to our Site:

  • Only the flagship Superhuman Health Protocol service offers a 14 day "Love it or leave it" guarantee.

  • This guarantee does not transfer to any other product or service offered.

Consumer Protection Law

Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Our Site contains links to third party websites or services that we do not own or control.

We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site.

It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability

Alexander Joel Brookes and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site and the services of Imperion Health LTD you indemnify and hold harmless Alexander Joel Brookes and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions for any direct, indirect, special, incidental, or consequential damages arising out of or in connection with the Program; including but not limited to; claims, losses, damages, liabilities, expenses including legal fees, goodwill, use, data or other intangible losses, even if Superhuman Health has been advised of the possibility of such damages. Arising out of your use of our Site or your violation of these Terms and Conditions.

The total liability of Imperion Health LTD to the client for any and all claims arising out of or in connection with the Program shall be limited to the total amount paid by the client for the Program.

The client acknowledges and agrees that Imperion Health LTD does not guarantee specific health outcomes, and that the client assumes full responsibility for their own health decisions and outcomes.The client further acknowledges and agrees to the risks associated with the program, including but not limited to the risks associated with changes in diet, exercise, and lifestyle.The client understands that any dietary or supplemental suggestions made by Imperion Health LTD are merely educational guidelines in purpose and not intended as the diagnosis, cure, or treatment for any disease.

The client acknowledges their legal responsibility for all food and supplements consumed, and that their primary healthcare provider is responsible for supervising any lifestyle changes the client chooses to make, including but not limited to; diet, nutrient and supplement intake.

The client waives all responsibility for health complications that may arise from following the guidelines given by the coaches at Imperion Health LTD.

Additional Terms

Program Content

The educational and informational content provided by Imperion Health LTD is intended for a general audience and does not claim to be, nor should it be construed as, medical advice or counselling. The program's content focuses on:

  • Improving health and performances;

  • Improving body composition as a byproduct;

  • Improving longevity;

    Should you have any medical healthcare concerns, please seek guidance from your registered medical professional.

    All materials are for individual use only and may not be sold, recorded, shared, taught, given away, or otherwise divulged without the express written consent of Imperion Health LTD.

    Your success with the program is largely driven by your willingness to take actions as recommended.

    Intellectual Property

The client acknowledges that any resources provided are the property of Imperion Health LTD and may not be used for commercial purposes or shared without explicit written consent.

Upon termination of the coaching period or failure to complete payments, the client loses access to any and all resources.

Services

The parties agree that this agreement constitutes an engagement in a minimum term of the specified programme duration. Which The Client agrees to check before purchasing.The agreement will extend beyond this in the instance of the client continuing the coaching service into a rolling monthly contract, where applicable and depending on service purchased. Whereby coaching shall be conducted online via various platforms.

In the instance of purchase of a package that moves into a monthly subscription, payment will be collected after the pre-specified term date. Cancellation of which must be made, in writing, with no later than 30 days notice prior to membership payment collection from your nominated payment method.

The client agrees that they have a responsibility to be proactive with reaching out for support and guidance as well as a responsibility to maintain clear and honest communication with their coaching team.

Inclusive of any personal changes which may impact the guidance which is then provided to them or amendments made to their health education protocol.

The client agrees that they will regularly use the designated support systems that are in place for their respective programmes. As well as to attend a minimum of 60% of the pre-arranged live call support sessions (if applicable for the product purchased) throughout the duration of their membership.

Informed Consent

The client consents to participate voluntarily in an online health program and recognises this program may contain certain inherent risks.

The client expressly assumes the risks of the program and takes full responsibility for their life and well-being and all decisions made before, during and after the program. The client acknowledges that there is no guarantee in terms of the expected outcomes of any health goals, problems, and/or medical ailments.

Nor shall the client cohere recommended protocols with guaranteed results for any health problems, goals and/or medical ailments. The client understands that they should continue to seek guidance from their registered, medical healthcare provider with regards to any and all prescription based medication. Including discussing any possible lifestyle changes that the client would like to explore with their medical healthcare provider.

Should the client be experiencing a medical emergency, the client understands they should immediately call their national medical emergency service to seek urgent care.

Relationship

The coaches at the company shall maintain a professional relationship with the client conforming with proper ethics and standards established by the International Coach Federation. Client's progress for developing his/her physical, mental, and emotional well-being, the acts and decisions shall be his/her/their own responsibility.

The Coaches shall only support, assist, and help the client with the realisations for those choices.

The Coaches shall not be responsible for any acts or omissions which may have direct or indirect results of the services provided by the Coaches.

The Client understands the Coaches are not therapists and shall not substitute for any cure for the mental or medical disorder. The Client acknowledges that this agreement does not involve the diagnosis or treatment of emotional disorders, neither this agreement may be used as a substitute for counselling, psychotherapy, legal advice, or other professional advice by other qualified professionals.

For the coaching relationship to be fruitful, the client must communicate honestly and must be open to feedback and constructive criticism.

Terms of Sale

You agree to waive any/all rights to charge-back, dispute, or make claims against any payment made to Imperion Health LTD as being fraudulent, purchased in error, services not delivered to you, or any other dispute which claims that any payment is unlawful.

Confidentiality and Privacy

We respect your privacy. Any information obtained about your medical history, current symptoms or blood test results will be treated as privileged and confidential unless agreed otherwise. We are committed to ensuring the security and protection of the personal data that we process, in compliance with relevant data protection laws. We will not disclose your personal information to any third party without your consent, unless required by law.

Right to Use Name & Likeness

By using our services, you consent to the use of your name, photograph, likeness, voice, testimonial and biographical material, in whole or in part, for publication or reproduction in any medium for purposes including, but not limited to, public relations, education, advertising, marketing, training and research.This consent extends to such use without restriction or limitation as to time or geographic boundary.

You waive all rights to any claims or demands for payment or royalties in connection with the use of any of such materials.

Privacy Policy

By using our services, you agree that your participation is subject to Imperion Health LTD’s Privacy Policy.

You agree to adhere to all terms as outlined.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. While we do not anticipate frequent changes, Superhuman Health reserves the right to modify this policy at its sole discretion and without notifying users.
